Service
1. At The Solution Automotive Ltd, we are able to offer an efficient recruitment service. We have developed new ways to tackle old problems and can advise on all aspects of recruitment. If a search of our active candidate database is likely to be successful, we will proceed immediately. If, in our opinion, an alternate method of recruitment (e.g. advertising, mystery shopping) is more appropriate, we will provide you with costed options and timescales.
Throughout all dealings with The Solution, you will find that our focus is on delivering a fast and effective service;
• To seek out and shortlist suitable candidates who meet your predetermined requirements.
• To furnish you with C.V.s and arrange interviews.
• To work closely with both you and candidates to result in a successful acquisition for you, the Client.
Acceptance of Terms
2. By reviewing a C.V. for, interviewing or employing in any manner a candidate introduced by The Solution Automotive Ltd, acting as an employment agency the Client is deemed to have agreed to and accepted the following terms. The terms may not be varied except in writing by a Director or Senior Manager of The Solution Automotive Ltd.
Fees
3. The fee payable by the Client to The Solution Automotive Ltd is for the introduction of a candidate which results in that candidate being engaged by the Client under a contract of employment, whether such an offer is made immediately or at anytime within a six month period following the date of final interview.
To avoid any doubt, ‘introduction’ means the presentation of a candidate to the Client by The Solution Automotive Ltd whether or not that candidate was known previously by the Client.
4. The fees payable are calculated as a percentage based on basic annual salary offered.
All fees are subject to VAT at the current rate.
Where the Client requires an advertised campaign then the same fee levels apply, payable in three stages;
• 1st third of fee - upon instruction of assignment
• 2nd third of fee - upon presentation of shortlist
• 3rd third of fee - upon candidate acceptance
5. Should the Client fail to notify or disclose to The Solution Automotive Ltd that an introduction has resulted in employment of a candidate then The Solution Automotive Ltd reserves the right to charge the client in accordance with the scale above. In such cases, no guarantee will be issued.
6. Should lines of communication not be kept open by the Client following the presentation of a candidate, The Solution Automotive Ltd reserves the right to raise and issue an invoice to cover expenses incurred. This invoice will be 10% of the estimated invoice value.
Guarantees
7. In the unlikely event of a candidate proving to be unsuitable within three months, then The Solution Automotive Ltd reserve the right to offer an acceptable replacement within fourteen days. Should this not be possible, then we will rebate 50% of the fee, provided that the payment terms have been adhered to. Should the fee level be negotiated further after assignments have commenced, all guarantees will become null and void.
Payment Terms
8. The invoice is payable by the Client within 7 days of the start date of the candidate. Should an invoice remain unpaid for 7 days after the start date the Client shall lose all rights to claim under the guarantee scheme.
Liabilities
9. The Solution Automotive Ltd accept no liability of any kind for any loss or damage whatsoever of, for any injury to or death of any persons arising directly or indirectly from the acts, errors or omissions of any candidate introduced even if such an act, error or omission is negligent, fraudulent or dishonest.
General
10. The English Courts shall have sole jurisdiction in any dispute arising regarding the construction and application of these terms.
